Personal use in California: Health and Safety Code Section 11357.
Adults (21 year and older):
Recreational use of marijuana became legal in California on January 1, 2018 for those 21 years and older under Proposition 64.
Adults age 21 and older may now legally possess up to
* One (1) ounce of dried marijuana (28.5 grams) OR
* Eight (8) grams of concentrated cannabis under California law.
Adults age 21 and older may also grow up to six (6) plants for their personal use, subject to certain restrictions. Adults who exceed these amounts of recreational cannabis can be charged with a misdemeanor punishable by a fine up to $500 and/or jail for up to 6 months.
People under age 21 years who possess marijuana can be charged with an infraction and sentenced to a fine or to drug counseling and community service (if under 18 years).
Sale and Transport in California
It is still a crime to sell and transport to sell marijuana in California. It is a crime to possess marijuana with the intent to sell it unless you have a state and local license.
Marijuana is still illegal under federal law.
You can be charged with a DUI with marijuana or any other drugs (legal, illegal, prescribed, over the counter) under Vehicle Code Section 23152(f).
