California Vehicle Code (CVC) Section 23152(a)

1. Defendant drove a motor vehicle; AND

2. Defendant did so while under the influence of an alcoholic beverage.

1. Defendant drove a motor vehicle; AND

2. Defendant did so with 0.08 percent or more, by weight, of alcohol in his or her blood.
